Thanks Michael. The shortcut may have been shoe-horning the RvW into a constitutional notch in the first place. That was and has been a hot topic in law schools and justice departments ever since. What should have happened was to follow that up with legislation and make it the law. Neither side of the aisle wanted to have that battle though as neither saw any glimmer of compromise. It was a black or white situation…fully polarized…and thus seen as insoluble….so they simply blew if off and did nothing. Had the parties had the principles and intestinal fortitude they could have worked out legal language that would have allowed for passage. It would not have been everything either side wanted, but that is the point of democracy. Everybody gets heard and considered.
